A Statement of Use Extension allows trademark applicants to request additional time to begin using their mark in commerce. When you file a trademark application based on intent-to-use, you must eventually demonstrate actual use of the mark. If you need more time to launch your product or service, you can file for a 6-month extension.
You can file up to five total extensions (including the initial request), giving you up to 36 months from your original filing date to begin using your trademark in commerce. Each extension provides an additional 6 months.
If you don't file a Statement of Use or request an extension before the deadline, your trademark application will be abandoned. This means you'll lose your filing date and priority rights, and others may be able to file for similar marks.
The extension filing is typically processed within 2-3 months by the USPTO. Once filed, your application is protected during this period, so there's no need to worry about abandonment while waiting for approval.
No, the purpose of an extension is to give you more time to begin using the mark in commerce. You cannot sell products under the trademark until you've actually begun using the mark and filed a Statement of Use demonstrating that use.
